Home Owners’ Association (HOA) Governing Documents
Our HOA has governing documents that are the legal guidelines for residents living in our community, as well as the management of our HOA. The Articles of Incorporation define the structure of our HOA. In Florida, the hierarchy of laws is as follows:
The documents are the:
- Federal Law
- State Law
- Local Law
- By Laws
- Declaration of Covenants and Restrictions
- Operating Rules and Policies
The governing documents reside in the Keys-Caldwell website under “Association Documents” and are available there for any association member to view and/or download. Residents of any HOA must comply with the rules set forth in the association governing documents.
Due to the way the neighborhoods were developed, there are a few exceptions to the Governing Documents depending on your residential neighborhood.
The Lakes of Jacaranda: The Lakes of Jacaranda (LOJ) Governing Documents listed in the LOJ neighborhood section, site areas where rules are different from the LOWofJ rules. For example: Shingled roofs are allowed in the LOWofJ documents but, the LOJ Governing Documents require that roofs be concrete tile or “such other materials as are approved by the Architectural Review Committee”.
Park Estates: The Park Estates (PE) Governing Documents listed in the PE neighborhood section, site areas where rules are different from the LOWofJ rules. For example: Trade or business from the homeowner’s residence is allowed as long as it meets the rules set forth for Park Estates’ DECLARATION OF COVENANTS AND RESTRICTIONS as amended on the 15th day of July, 2016.
